CASE SCENARIO 1


Zanele Dube is a science teacher at a high school and is considering using the following materials in her science classes:
 
·       Excerpts from Darwin’s book "On The Origin of Species", published in 1859
·       A Genetic Code Chart, http://www.indiana.edu/~ensiweb/lessons/psa.gc.pdf
·       A clip from an SABC TV science documentary series which Zanele taped from television;
·       Clips from the film “Jurassic Park”
·       Images of the nine planets which Zanele downloaded from the Internet
·       A one page fact sheet about the Evolution she designed and compiled which includes short extracts and images from http://www.guardian.co.uk/science/interactive/2009/feb/12/charles-darwin;
·       Zanele’s own original drawings and photographs of animals, trees and fauna she created while on holiday;
·       Zanele’s own original research & teaching notes and text about Galileo, prepared as part of her teaching job.

  1. Identify which type of material (work and/or subject matter) is represented by each of the resources.
  2. Identify whether or not each of the works and/or subject matter is protected by copyright and who owns copyright in the work. Explain your answers.

 
 
Things you should think about when answering the above questions(not be answered)

  1. What is copyright ?
  2. What activities does copyright prohibit ?
  3. Does copyright protect ideas or only expressions?
  4. What types of materials does copyright cover?
  5. What requirements must a resource meet for copyright to apply in South Africa?
  6. What is the public domain? When does something enter the public domain?
  7. How long does copyright last? Is this the same for different types of material?
  8. What are the rights of authors/copyright owners?
  9. Who owns copyright in employment situations?
