I did random clicking to get here. I cannot see the discussin board for Aqua on the main page.
Submissions:
1. Which of the above works are subject to copyright? Why and why not in each case?

“In many cases, copyright depends on when the creator died, even if the creator did not own copyright. Note that periods of copyright protection vary from country to country, and a work that is in the public domain in Australia may still be protected by copyright in other countries.” http://www.copyright.org.au/information/cit019/wp0031

Keeping in mind “fair dealing’, teachers can reproduce and communicate as part of educational instruction under the ScreenRights Agreement (after acknowledging the source). At present, individual schools do not need to keep records.

The Darwin images from the Guardian UK site can be used for personal research and class instruction (under “Flexible dealing”), but not resold. There is no copyright on photos taken before 1955, whether published or not.

“You may download and print extracts from the material and make copies of these for your own personal and non-commercial use only.

You must not reproduce any part of guardian.co.uk or the material or transmit it to or store it in any other website or disseminate any part of the material in any other form, unless we have indicated that you may do so.” Guardian Terms of Service http://users.guardian.co.uk/help/article/0,,933909,00.html

"The Origin of the Species" is out of copyright and available at http://www.literature.org/faq.html

Genetic Code Chart is common knowledge and freely available.

Depending on the school, clips from free to air are available for teachers to use in an education context under ScreenRights agreement. Presuming that ‘Fair dealing” exists, Similarly, if the film “Creation” has been on TV it is permissible to use clips. Teachers cannot “rip” or remove copy protection devices from DVDs. These cannot be used outside the classroom

Zanele owns the copyright on her own drawings and photos, quizzes, teaching notes etc, (presuming that they are not direct copies of other works).

2. Is Zanele Dube’s resource protected by copyright? Why or why not?
Unless Zanele made this resource under direct instruction for her employing authority, Zanele Dube’s resource is protected by copyright because she is responsible for the creation of it. It enters the public domain once she has putit all together.

3. Does she need permission to reproduce any of the above to include in the DVDs she gives to her students?
Depending on the source of the film “Creation” and how much Zanele uses, Zanele does not need permission to make the DVD for instruction for her class.

4. Does the Publisher need permission to reproduce the resource and/or any of the above included in the resource and if so, who are the copyright owners?

The Guardian site clearly states that its images are not to be resold. The clip from BBC TV can be used in class, but not resold without permission.
