Hi,
I'm excited to be starting this course and looking forward to getting to know you all.

I'm an educator in the broadest sense. I've worked for the VA for about three years, developing instructional materials and facilitating large training conferences for physicians, nurses, psychologists, social workers, etc.

Before that, I worked for quite a while at the University of New Mexico and the University of Iowa, mostly as a researcher, in the Departments of Medicine at both schools.

I currently live in Lynnwood Washington, just north of Seattle.

My name is Damon Huss, and I am also an educator in a broad sense. I work as a curriculum developer, writer, and teacher-trainer for the Constitutional Rights Foundation in Los Angeles, California. Before that, I was a middle-school teacher for nine years and also an attorney.

I'm hoping to refine my very general knowledge about copyright, especially with regard to development of classroom materials, which is a major part of my work.

Did week 1 change from the 15th to the 2nd?

I am in New Jersey. Bio notes posted on profile. I have taught online for 10 years, but finding this particular "LMS" setup to be a bit awkward to navigate.

Case Study for Week 1

1. The extracts from Charles Darwin's personal diaries, notebooks, and "The Origin of the Species" are all in public domain. He lived from 12 February 1809 to 19 April 1882. We are well past the 70 years after his death.

2. The video clips from the BBC TV documentary and the film "Creation" are under copyright. "Creation" just came out on 22 January 2010. There are video clips and a trailer available on the website (creationthemovie.com). A link to these resources could without a doubt be included in the DVD. It is also very likely that the short clips would be ok, for use for her class. She would need to reference this site. I'm not so sure about that would work if she were to publish her DVD.

3. The images from the Guardian News & Media Limited website are copyrighted. However, she can use them for the DVD for her class (not for publication) as stated in the website: "You may download and print extracts from the material and make copies of these for your own personal and non-commercial use only." She would need to reference this site.

4. The Genetic Code Chart is not protected by US copyright and if she wants to be perfectly free, she could use the chart on the governments website (molbio.info.nih.gov/gcode.html). As stated in the "Copyright Basics for our readings this week - this is US copyright basics as works not eligible for copyright - "works consisting entirely of information that is common property and containing no original authorship" (p 3) or "works by the U.S. government" (p 5).

5. Her original drawings, quizzes, etc. are her property UNLESS in her signed contract with her school they have stated that her works created for the classroom belong to the school. If she is working in a school, particularly public school in the U.S., it is very unlikely that the school has declared ownership of the materials she creates for her classroom.

6. Now for the discussion of publishing this DVD. The only materials that have some copyright implications would be the video clips and the images. I would also have some reservations about the Genetic Code Chart. I might make some slight changes to the organization of the chart - or add some commentary to the chart. The information holds no copyright, but the specific organization of the information may. Regarding the images, I would search for public domain images, which are surely available considering the death date of Charles Darwin. And finally, before publishing the DVD, permissions would need to be received from BBC regarding the documentary and BBC Films and Ocean Pictures regarding the clips from the film.

Thanks for putting this all together. These are some great thoughts and observations.

I have a couple of questions and comments:

1. The Images on the Guardian website are photos and drawings taken around the time Darwin was alive. It seems like they shouldn't be covered by copyright but the narrated slide show the Guardian did should be. Couldn't Zanele get copies of those pictures from the Gaurdian site and use them?

2. One of our questions for this week asks if Zanele's resource is covered by copyright. Her work is a mix of things, some are copyrighted, some are in the public domain, and some are her own creation (including the layout of the DVD itself). Can this be copyrighted? For instance, if she just showed this to her kids in class, could she tell them that she has a copyright? Does she only have copyright to portions of the presentation?

3. I believe that the genetic code chart falls under the exclusion for widely known information that cannot be copyrighted. Similar charts have appeared in textbooks for decades.

3. "She plans to make 20 DVD copies of the resource to give to her students to use as part of the class group science project." I think she is safe under Fair Use (search the Hofman pdf p 65 is the start)

4. "After the conference she was approached by an educational publisher who would like to publish and reproduce the resource." The publisher would need to obtain rights for some of the protected resources as noted by others.

which says:
"Darwin Online cannot give permission to reproduce the manuscripts, that is, hand-written documents, on the site. Such requests must be sent to the owner of the manuscript. In most instances this will be Adam Perkins, Curator of Scientific Manuscripts in Cambridge University Library (ajp21@cam.ac.uk or mss@lib.cam.ac.uk). Certain other materials, for which Darwin Online has received reproduction permission, may not be reproduced without the permission of the original copyright holder." It may be that their images (microfilm) are copyrighted but that the words are not.

I think you make a very good point - that whether the Darwin material is copyrighted may depend on what, exactly, Zanele is using. If she's simply reproducing the words Darwin wrote, that might be different than using other kinds of materials, like reproduced manuscripts.

I think we all agree that Zanele's classroom copying is probably ok under fair use considerations.

Here's something that I found helpful, and that we may need for future scenarios - the 4 factors to consider for fair use (from http://www.col.org/SiteCollectionDocuments/Introducing_Copyright_online_...)

(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
(2) the nature of the copyrighted work;
(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
(4) the effect of the use upon the potential market for or value of the copyrighted work . .

How do you send an e-mail to the group instead of a message-board post? Someone in the Pink Group sent an e-mail suggesting that a wiki is a better format for collaboration, and I agree.

But I don't know how to respond to the e-mail. What am I missing? I'm also getting e-mails from the Brown Group(?).

I find the platform for the material awkward to use (and I've been using online course materials for 10 years). P2PU should use Moodle!
I still get no email notifications. I'm OK being the cut & paste person for a week's answer though I don't feel we have a complete week one answer.
Is there a page that actually shows our entire pink group? How many are we? We should select/assign weeks.

I don't mind turning in the assignment as it is on the wiki today 28 which is the due date. I'll wait till near midnight EDT.

the Group Assessment of Other Group Assignments is due Friday 2 - Is that something we can/should also do on the wiki? I did click the wikis for other groups (there seem to be 9 groups) and there was nothing there. Seems like it would take A LOT of clicks to find all the other groups' answers.

Also, there only seems to be a few of us "active" in this group, so...

Hi. My group hasn't been using the wiki (since there are only 2 of us), but you can should be able to find the final version of other groups' assignments without too many clicks by going to the 'view' tab, and then clicking on the particular assignment. So far, there are three assignments for 'week 1' and one more under the general 'assignments' heading. All the best, Phil (from the Limey group)
