I'm Kit Keller, and I've worked as a librarian for many years. Most of my professional career was spent at the Nebraska Library Commission. For the past two years I've worked as an online librarian for a for-profit organization. I am especially interested in how copyright should function in a for-profit, educational setting.

I'm Cynthia, and I do social science research in Half Moon Bay, California at a non profit that studies issues around open educational resources and licensing. I'm looking forward to delving deeper into non restrictive licensing and seeing what we come up with as a group. Go to VIEW tab, then scroll down to Case Study Scenerio Week 1. This gives us the scenerio that our group needs to discuss and then submit the group answer to the questions by the end of the week...we will need to pick a group leader to submit the groups answer.

It looks like there are 5 of us in the Blue Group (counting the posts). And there are 8 items on the case study list. How shall we divide this? Should we all find an answer for each of the eight? Or do you want to divide it?

Well I think that we should first layout each item and then give everyone a chance to comment on it until we arrive at the most definitive answer for each. We would all have to agree on the answers before we upload them. I wish we had a Wikki to do this. Thoughts?

1. Identify the types of copyright works or other subject in the material she wants to use.
- Darwin’s personal diaries and notebooks would be literary in nature.
- The images from the Guardian UK would be artistic in nature.
- The Genetic code chart – there is so little information here. Does this fall under the “list of ingredients” description that can not be copyright?
- Clip from BBC series is artistic in nature.
- Clip from Creation film is artistic in nature.
- Her own drawings/photos would be artistic in nature
- Her own quizzes, research, and text would be literary in nature.

2. Identify the copyright owner for each category of work or other subject matter.
- Darwin’s personal diaries and notebooks should be in the public domain, as the copyright has expired (unless she made copies or scans directly from a more recent, copyrighted publication).
- The copyright from the Guardian UK images would be owned by the photographer
- The Genetic code chart – I’m thinking this has no copyright.
- The BBC clip is owned by the BBC
- The clip from Creation was based on the book “Annie’s Box” by Randal Keynes. Keynes, I would assume allowed the derivative Creation screenplay to be written by John Collee (who was possibly hired by the production company to do the job). Therefore, I assume the production company, Recorded Picture Company. The BBC appears to have had some hand in the film, as well as the UK Film Council.
- Dube owns the copyright to her own original drawings and photographs, assuming they were taken on her own time (and not during school hours).
- Dube owns the copyright to teaching materials, assuming they were taken on her own time and not during school hours. If they were created on the clock, the copyright belongs to the school.
3. Identify which of the above works or other subject matter are still in copyright.
- The BBC film clip, Creation clip, Guardian UK pictures, and her own photos/drawings/quizzes/writings are still in copyright. The copyright on extracts from Darwin’s writings have expired (unless she is copying/scanning them directly from more recent, copyrighted textx).
4. Is Zanele Dube’s resource protected by copyright?
- If all of the contents were permissible, her school would own the copyright, no?
5. Does the Publisher need permission to reproduce the resource and/or any of the above included in the resource ?
- The publisher would need permission to reproduce the Guardian UK content, the BBC clip, the Creation clip, Dube’s drawings/photos/education materials.

Extracts from Darwin personal diaries & notebooks are literary works but now public domain because he died 70+ years ago. No copyright.
Images of Darwin from the Guardian website are copyrighted by the website as stated by the website. Permission needed.
The Genetic Code is an example of common knowledge therefore no copyright.
The BBC clip “Life” was broadcast show out on the free airwaves and can be taped for non-commercial viewing but not reproduced or sold without permission. She can show excerpts of this tape in class, but, copyright is in effect if publishing it on a DVD and needs permission. The clips shown in the classroom falls under the Fair use Act.
Zanele Dube owns the copyright to her own drawing and photograph creations. Since she is the copyright holder she gives permission for use.
Zanele Dube’s original quizzes, research, teaching notes and text about Darwin were produced as a part of her job as an instructor, therefore the school owns the copyright and only the school gives permission for reproduction.
3. Identify which of the above works or subject matter are still in copyright.
Images of Darwin
BBC-TV documentary “Life”
“Creation” film
Zanele Dube’s original drawings & photographs
Zanele Dube’s original quizzes, research, teaching notes, Darwin text.
4. Is Zanele Dube’s resource protected by copyright?
Zanele’s original works (drawings & photographs) are copyrighted even thought there is no mention about them being published.
Her original quizzes, research, teaching notes and Darwin text were produced as a resource for her classes while employed by the school, therefore, these works are not her copyright but the schools.

5. Does the Publisher need permission to reproduce the resource and/or any of the above included in the resource?
The publisher needs permissions from many sources in order to publish this DVD.
The school will need to grant the permission to publish the class DVD, since Zanele produced this DVD as a class resource while being employed by the school.
The other resources on this DVD will all need permissions because they are all copyrighted works, except for the out of copyright or the common knowledge works already identified

No...he & his wife moved there just because they liked it. He's a woodworker and she's a nurse. We've been there a couple times and like it as well.
